Terms of service

Luni Echo ("Luni") is provided by the individual operator identified in section 19, trading as LE Software ("we," "us," or "our"). These Terms of Service ("Terms") form an agreement between you and that operator. They govern your access to the Luni Echo mobile application, website, and related services (the "Service").

By creating an account or using the Service, you agree to these Terms and acknowledge the Luni Echo Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to enter a binding contract where you live. You may use the Service for yourself. You may not create an account for a person under 18 or allow a person under 18 to use your account.

2. The Service

Luni provides an AI companion for text conversations, personalization, and related features described in the app. These conversations are generated by AI and do not represent a relationship with a real person. The acceptable-use rules below apply to all conversations. Features may change as we test and develop the Service.

Luni uses automated systems to generate responses. A human does not write or approve each response. The system may produce inaccurate, incomplete, offensive, unsafe, or unsuitable content. Use your judgment before relying on a response.

3. No professional or emergency service

Luni does not provide medical care, mental-health treatment, diagnosis, legal advice, financial advice, or another licensed professional service. The Service does not create a doctor-patient, therapist-client, lawyer-client, fiduciary, or similar professional relationship.

Luni does not monitor conversations as an emergency service and cannot contact emergency responders for you. If you or another person may face immediate danger, contact local emergency services or a qualified crisis service. Do not wait for a Luni response.

4. Your account

You must provide accurate account information, keep your login credentials confidential, and protect access to your device. You are responsible for activity under your account unless applicable law states otherwise.

Tell us at support@luniecho.com if you suspect unauthorized access. We may require email confirmation or recent authentication before allowing a sensitive action.

You may delete your account through Settings > Account > Delete account or by emailing support@luniecho.com. Account deletion cannot be reversed after processing begins.

5. Your content

"Your Content" means messages, report explanations, profile information, feedback, and other material you submit through the Service.

You keep any rights you hold in Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, adapt, and display Your Content only as needed to operate, secure, and support the Service, comply with law, and enforce these Terms. This license ends when we delete Your Content, except for copies that law permits or requires us to retain. We handle Your Content as described in the Privacy Policy. Luni does not use user data for model training, evaluation datasets, or testing.

You confirm that you have the rights needed to submit Your Content and that our permitted use will not violate another person's rights. Do not submit another person's private information without authority.

6. AI output

"Output" means content generated by the Service in response to your messages. Subject to applicable law and third-party rights, you may use Output only for personal, lawful, non-commercial purposes.

We do not promise that Output is unique. Other users may receive the same or similar content. We do not promise that you own intellectual-property rights in Output or that Output does not affect a third party's rights.

You must review Output before acting on it or sharing it. You accept the risk of relying on generated content, subject to rights that applicable law does not allow these Terms to limit.

7. Acceptable use

You may not use the Service to:

• break the law or violate another person's rights;
• exploit, endanger, sexualize, or abuse a child;
• create or distribute non-consensual intimate content or sexual content involving minors;
• threaten, harass, stalk, defame, or promote hatred or violence against a person or group;
• encourage self-harm or provide instructions intended to cause injury;
• obtain or expose passwords, financial credentials, government identifiers, or another person's private data;
• create malware, evade security controls, disrupt the Service, or probe systems without written permission;
• commit fraud, impersonate another person, manipulate civic processes, or deceive people about the origin of generated content;
• reverse engineer the Service except where law permits it;
• scrape, resell, sublicense, or provide automated access to the Service without written permission; or
• use Output as a substitute for qualified professional judgment in a high-impact decision about another person.

You may report an AI response from the message actions in the app. We may review reports and use them to enforce these Terms and improve safeguards.

8. Our rights in the Service

We and our licensors own the Service, including its software, design, branding, and documentation. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service according to these Terms. They do not transfer ownership of the Service or our trademarks to you.

If you send suggestions about the Service, you allow us to act on those suggestions without payment to you. We handle personal information in your feedback as described in the Privacy Policy.

9. Third-party services and Google Play

The Service relies on providers for authentication, hosting, databases, and AI generation. Those providers may process information under their own terms and our agreements with them. The Privacy Policy describes the types of providers we use and explains the related data handling.

Links to third-party sites do not mean that we endorse or control those sites. Their terms govern your use of them.

If you download Luni Echo through Google Play, these Terms are between you and us, not Google. We provide support for Luni Echo and handle questions and claims about the app. Google Play’s terms also apply to your use of the store. This section does not limit any rights or obligations that applicable law imposes on Google.

10. Changes, interruptions, and updates

We may add, change, suspend, or remove features to maintain security, comply with law, improve the Service, or address technical and business needs. We may release an update that you must install to keep using the Service.

The Service may experience delays, errors, or interruptions. We do not promise uninterrupted access or permanent storage of every message. Keep a separate copy of information you need to preserve.

11. Fees

The current version of Luni is free to use and has no paid features or subscriptions.

12. Suspension and termination

You may stop using the Service at any time. You may delete your account as described above.

We may restrict or suspend access when we have a reasonable basis to believe that you violated these Terms, created risk for users or the Service, or exposed the Service to legal or security risk. We may terminate an account for a serious or repeated violation. We will provide notice when law requires it or when doing so will not create additional risk. You may appeal an account suspension or termination by emailing support@luniecho.com. We will review your appeal.

Sections that concern ownership, disclaimers, liability, disputes, and obligations that arose before termination continue after termination.

13. Disclaimers

To the extent permitted by law, we provide the Service and Output on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

We do not warrant that the Service will meet your needs, remain available, preserve all data, or produce accurate or safe Output. These disclaimers do not exclude warranties or consumer rights that applicable law does not allow us to exclude.

14. Limitation of liability

To the extent permitted by applicable law, we and our employees and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, goodwill, opportunities, or data arising from the Service or Output.

To the extent permitted by applicable law, the combined total liability of us and our employees and contractors for all claims arising from the Service or these Terms will not exceed the greater of:

• US$49; or
• the amount you paid us for the Service during the six months before the event giving rise to the claim.

These exclusions and limits apply whether a claim is based on contract, negligence, or another legal basis. They do not exclude or limit liability that applicable law does not allow us to exclude or limit, or remove mandatory consumer rights.

15. Indemnity

To the extent permitted by applicable law, you will indemnify us and our employees and contractors against third-party claims, damages, and reasonable legal costs to the extent caused by your unlawful use of the Service, content you submit that is unlawful or infringes another person’s rights, or your material breach of these Terms.

You are not responsible under this section for losses caused by our own negligence, misconduct, or breach of these Terms, or that of our employees or contractors. This section does not impose an obligation that applicable law prohibits or limit mandatory consumer rights.

16. Disputes

To the extent permitted by applicable law, disputes will be brought before the competent courts in Delhi, India, where those courts otherwise have jurisdiction. This clause does not prevent you from bringing a claim before another court or consumer forum where mandatory law gives you that right.

Before filing a claim, you and Luni agree to send a written description of the dispute to the other party and allow 30 days for a response. Send notices to support@luniecho.com. This informal process does not stop either party from seeking urgent relief or using a consumer forum where permitted.

17. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or risk controls. We will publish the revised Terms with their effective date. For material changes, we will provide advance notice through the app or the email address associated with your account, explaining the changes and stating when they take effect.

If an urgent legal or security requirement makes advance notice impractical, we may make the necessary change sooner and notify you as soon as reasonably possible, subject to applicable law. Where required, we will ask for your agreement to the revised Terms. If you do not accept the changes, you may stop using the Service and request account deletion.

18. General terms

If a court finds part of these Terms unenforceable, the remaining provisions remain in effect. A delay in enforcing a provision does not waive it. You may not transfer your rights under these Terms without our written consent. We may transfer these Terms as part of a merger, acquisition, reorganization, or sale of the Service, subject to applicable law.

These Terms and the Privacy Policy form the agreement between you and us concerning the Service. They replace earlier agreements about the same subject.
